Per a U.S. Citizenship and Immigration services (USCIS) announcement, the FY2026 H-1B cap limit is now fulfilled. No further selections are expected. The congressionally mandated limit is expected to be reached from current selections. The agency continues to process H-1B cap petitions for those selected and for non-cap visas.
The H-1B visa is a non-immigrant visa allowing temporary employment to foreign workers. There are two different H-1B categories mandated by congress. The regular H-1B cap requires 65,000 visas, while the advanced degree cap requires 20,000 visas.
USCIS will keep accepting and processing petitions filed to:
- Extend the amount of time a current H-1B worker may remain in the United States.
- Change the terms of employment for current H-1B workers.
- Allow current H-1B workers to change employers.
- Allow current H-1B workers to work concurrently in additional H-1B positions.
Previously filed petitions filed for current H-1B workers will retain their place in the visa cap. They also won’t count towards the FY2026 H-1B Cap. H-1B petitioners can view H-1B cap updates on the USCIS’ H-1B cap season email.
